Can You Remove A CCJ?
"My CCJ’s were put into the debt management plan and will be settled in full before the end of the year."
Despite the claims of some companies removing a CCJ Is not straight forward. The only way to have a CCJ removed from the Register of County Court Judgments is to prove it was listed in error.
If you believe you have a valid case then by completing form N244 the county court will examine the case again and hopefully support your claim. At Debt Trust UK we can examine the paperwork you received to check whether the rules were followed.
For example you must be given 21 days to respond to the claim and the plaintiff should have issued you with a default notice prior to applying for the CCJ. Another reasons why a CCJ could be removed is that you were unable to attend court to defend yourself or perhaps the credit was taken out without your knowledge i.e. identity fraud.
Settling a CCJ
Usually a CCJ cannot be removed and the best way forward is to settle it off. By clearing your CCJs your credit rating will improve immediately and it demonstrates that you are dealing with your debts in a responsible manner.
As part of a Debt Management Plan we would look to include your CCJs and could even agree a reduced settlement on your behalf. As soon as the debt has been satisfied the creditor will then agree that the CCJ can be listed as settled on the official register.
It is normally then advisable to obtain a certificate of satisfaction from the court (£10) which can be sent to the credit reference agencies to ensure they are aware of the change.
A settled CCJ is far less damaging so why not contact Debt Trust UK today to see if we can help pay it off.
Dealing With Arrears
Clearly the best approach is to avoid a CCJ in the first place.
Most creditors view a CCJ as a last resort and will have attempted to reach an agreement with you many times before taking you to court. Unfortunately most people find it difficult to deal with debt collectors and do not understand the deals that can be made with them.
At Debt Trust UK we specialise in dealing with arrears and can help you avoid a CCJ. We help people by organising their finances and prioritising their debts.
By speaking to creditors on your behalf we can also stop the nasty letters and take away the stress of being in debt. In most cases the creditors are approachable and we may even be able to write off some of your debt completely.
